Mass Incarceration and Family Policing Are One System

The Prison Policy Initiative has released Women’s Mass Incarceration: The Whole Pie 2026, showing that nearly 200,000 women are locked up in the U.S. on any given day.

Key findings

  • About 81,000 women are in state prisons, a fast rebound since the pandemic
  • About 87,000 are in local jails, and most haven’t been convicted; they’re awaiting trial
  • ICE detention of women and girls is up 31% since 2024
  • Three in four women under correctional control are on probation or parole, where unrealistic conditions often lead back to incarceration

Where the two systems meet

Most incarcerated women are mothers, and the same conditions that put them behind bars (poverty, drug use, untreated mental health needs) are the ones CPS labels as “neglect.” The criminal legal system and the family policing system target the same families, share information, and punish the same struggles.

When a mom is arrested, even for a few days while awaiting trial, her children can be placed in foster care. Under federal law, parental rights can be terminated after a child has spent 15 of the last 22 months in foster care, which is shorter than many sentences. Jail time can cost a mother her family permanently.

Probation and parole add another layer: a missed check-in or a failed drug test can trigger both a violation and a CPS case. Women are caught between two systems that watch them, judge them, and separate them from the people they love.

At CRP, we believe safety comes from supporting families, not policing and separating them. As members of the Lived Experience Experts Collaborative (LEX), we organize alongside people directly impacted by family separation to protect Black families and end all separations.
